Section 22 of the Election Act has been declared unconstitutional by the High Court. It requires those vying for Parliamentary and Ward Representative seats to have obtained a degree from a recognized university.

The ruling was made by Justice Antony Mrima after a petition was made by two parties seeking to have the Act declared unconstitutional.
“An order is hereby issued declaring Section 221 (b) as unconstitutional for failure to undertake public participation. Further, a declaration is also hereby issued that Section 22 (1B) of the Election Act is in-operational and is of no legal effect”, Justice Mrima ruled.
Seven petitioners including the County Assemblies Forum (CAF) had lodged the suit in court.
